IPINAGDIWANG ni Department of Budget and Management (DBM) Secretary Amenah “Mina” Pangandaman ang isang makabuluhang sandali ngayong araw, Hulyo 20, 2024, nang pirmahan ni Pangulong Ferdinand “Bongbong” Marcos Jr. ang New Government Procurement Act (NGPA) bilang batas, na inilalarawan niya bilang isang “transformative reform” na magpapabago at magpapabuti sa mga proseso ng public procurement sa Pilipinas sa pamamagitan ng pagtugon sa mga umiiral na loopholes at inefficiencies.
“From my very first day at the DBM, procurement reform has been a paramount priority on my agenda. The signing of the NGPA is a monumental step forward in our pursuit of a more efficient, transparent, and accountable government procurement system,” pahayag ni Secretary Mina.
“It will undoubtedly enhance the implementation of projects and the procurement of goods and supplies, ensuring better public service delivery for the Filipino people,” dagdag niya.
Pinangunahan ng DBM at inakda at itinaguyod ni Senador Sonny Angara, inaamyendahan ng makabuluhang batas ang ilang dekada nang Republic Act No. 9184, na kilala bilang Government Procurement Reform Act.
“We have just signed into law two new bills that will move us closer to attaining a strong, more responsive, and efficient bureaucracy and to establishing safeguards for the financial rights and welfare of every Filipino,” ani Presidente sa kanyang keynote speech sa signing ceremony sa Macalañang.
“The NGPA streamlines the procurement process from three months to just 60 days by standardizing procurement forms and institutionalizing electronic procurement,” paliwanag ng Pangulo, na binibigyang-diin na isa sa pinakamahalagang pagbabago sa NGPA ay ang dramatic na pagpapaikli ng processing time.
Nakakamit ito sa pamamagitan ng pag-standardize ng mga form ng procurement at pag-institutionalize ng electronic procurement, na magpapabilis ng mga transaksyon at mababawas ng bureaucratic red tape.
Binanggit din ng Pangulo ang ilang safety features ng batas, na kasama ang probisyon para sa 11 bagong modalities sa procurement na magbibigay sa mga ahensya ng gobyerno ng higit na flexibility sa pagbili ng mga goods at services.
Kasama sa mga procurement modes na ito ang Competitive Bidding, Limited Source Bidding, Competitive Dialogue, Unsolicited Offer with Bid Matching, Direct Contracting, Direct Acquisition, Repeat Order, Small Value Procurement, Negotiated Procurement, Direct Sales, and Direct Procurement for Science, Technology, and Innovation.
Ipinakikilala din ng NGPA ang mga bagong konsepto tulad ng Most Economically Advantageous and Responsive Bid (MEARB) at ang Most Advantageous and Responsive Bid (MARB).
“This [MEARB] is an attempt to consider the qualitative economic value not the quantitative value of any proposal. It’s an alternative to the prevailing practice of choosing just the cheapest product or, what we now call, the Lowest Calculated and Responsive Bid,” binanggit ni President Ferdinand Marcos Jr.
“This frees us from the obligation of selecting the lowest-priced bid when there is a better choice. This will ensure that we get not only the best prices, but the best deals for our clients — the Filipino people,” dagdag niya.
Ang isa pang layunin ng batas ay ang magtatag ng propesyonalisasyon bilang isang pangunahing prinsipyo ng public procurement sa Pilipinas. Nakakamit ito sa pamamagitan ng pagbuo ng isang grupo ng mga mga procurement professionals na hindi lamang nagtataglay ng technical expertise ngunit sumusunod din sa mga ethical procurement practices.
“Mahabang proseso pa ito. After this signing, we will develop rules and regulations for new alternatives. Within the year, we will have our eMarketplace,” sinabi ni Secretary Pangandaman.
Hinahatid din ng NGPA ang electronic procurement sa pamamagitan ng centralized online system (PhilGEPS). Babaguhin ng eMarketplace ang pagprocure ng common-use supplies and equipment (CSE) sa pamamagitan ng pagiging main e-commerce platform ng gobyerno.
Ipinaabot ng Budget Secretary ang kanyang pasasalamat sa Pangulo gayundin sa pamunuan at mga miyembro ng Kongreso at Senado sa kanilang dedikasyon sa pagsasabatas ng kritikal na lehislasyon na ito.

Our appreciation extends to the House of Representatives, led by Speaker Martin Romualdez, and House Committee on Revision of Laws Chairperson Edward Maceda. Their unwavering support has been instrumental in making this significant reform a reality,” sinabi ni Sec Mina.
Isinama dito ang prinsipyo ng sustainable procurement upang makamit ang vallue for money habang pinapaliit ang epekto sa kapaligiran. Sa Green Public Procurement approach, inoobliga ang mga procuring entities na bigyang-prayoridad ang mga goods, infrastructure projects, at consulting services na may pinaliit na environmental impact sa kabuuan ng kanilang lifecycle.
Ang NGPA ay higit pang tumutulong sa isang Inclusive Procurement Program, na tinitiyak ang pantay na pagkakataon para sa mga vulnerable at marginalized na sektor, kabilang ang mga microenterprises, social enterprise, at mga startup. Hinihikayat nito ang mga procuring entity na aktibong isali ang mga sektor na ito sa mga procurement activities, binibigyang-diin ang inclusivity sa mga programa na kaugnay ng gender at ethnic equity, pagbabawas ng kahirapan, at pagsunod sa mga pangunahing pamantayan sa paggawa. Bukod pa rito, nagtatatag ang NGPA ng Joint Congressional Oversight Committee upang subaybayan ang pagpapatupad ng Batas.
Ginanap ang signing ceremony sa Ceremonial Hall ng Palasyo ng Malacañan, na dinaluhan ng mga pangunahing opisyal at mambabatas ng gobyerno. Kasama ni Secretary Pangandaman sina DBM executives Undersecretaries Wilford Wong, Margaux Salcedo, gayundin sina Assistant Secretaries Romeo Matthew Balanquit, Leonido “Bodie” Pulido at Diana Camacho-Mercado.
